Welcome to Rabbit Trail Studio. These Terms of Service ("Terms") govern your use of the rabbittrailstudio.com website (the "Site") and the services, products, and content offered by Rabbit Trail Studio ("we," "us," or "our").
By accessing the Site, purchasing products from our Shop, or commissioning custom work, you ("you," "the User," or "the Client") agree to be bound by these Terms.
1. Intellectual Property
All content on this Site, including but not limited to images, artwork, graphics, text, logos, and our original characters, is the exclusive property of Rabbit Trail Studio (Devin and Julia Wright) and is protected by international copyright laws. You may not copy, reproduce, republish, or distribute any content from this Site without our express written permission.
2. E-commerce & Shop Orders
This section governs the purchase of products (e.g., "Fine Art Prints," "T-Shirts," "Gifts") from our online Shop.

Print-on-Demand (POD) Service: Our shop items are custom-printed on demand by our production partners (such as Printify and Lumaprints). Because items are made to order, they require a production time of 3-7 business days before shipping.

Separate Shipments: Products may be fulfilled by different partners. If you order multiple item types (e.g., a print and a t-shirt), they will likely arrive in separate packages.

Returns & Exchanges: We do not accept returns or exchanges for buyer's remorse, ordering the wrong size, or changing your mind. All sales are final. Please review the size charts carefully before purchasing apparel.

Damaged or Defective Items: If your item arrives damaged or with a print defect, please contact us within 14 days of delivery. You must include your order number and clear photos of both the damaged item and the packaging. We will coordinate with our partner to send you a free replacement.

International Orders: Customers are solely responsible for any customs duties, tariffs, or VAT fees that may be applied upon import into their country.
3. Custom Art & Commissioned Services
This section governs custom projects (e.g., "Book Illustration," "Murals," "Custom Art," "Album Covers," "Brand Art").

No AI Guarantee: We guarantee that all artwork created by Rabbit Trail Studio is 100% original and made by hand. We never use generative AI in any part of our creative process.

Quotes & Contracts: All custom work requires a custom quote. All projects will be governed by a formal, separate Project Contract that will be provided to you. This contract will outline the specific scope of work, deliverables, timelines, payment milestones, and usage rights. The Project Contract will supersede these Terms of Service in the event of a conflict.

Deposits & Payments:

Single Illustrations: A 50% non-refundable deposit is required to secure your booking. The final 50% balance is due upon your approval of the final art, before delivery of high-resolution files.

Large-Scale Projects (Full Books, Murals, etc.): These projects begin with a $500 non-refundable Discovery & Booking Fee to cover initial consultation and development. This fee is then applied to your first project milestone. The remaining cost is broken into milestone payments as defined in your Project Contract.

All deposits and booking fees are non-refundable.

Copyright & Usage (Licensing):

Rabbit Trail Studio retains full copyright and ownership of all artwork we create.

The Client is purchasing a license to use the artwork for the specific, agreed-upon purpose detailed in the Project Contract (e.g., "for use as a book cover for one-time print run and e-book").

Any use of the art outside of the agreed-upon license (e.g., for merchandise, sequels, etc.) requires a new, separate license and additional fees.

Purchasing the full copyright (a "buyout" or "work-for-hire") is a separate service, is priced substantially higher, and must be negotiated explicitly in the Project Contract.

Portfolio Rights: We reserve the right to display all completed artwork in our portfolio, on our website, and on social media for self-promotional purposes. We will honor any pre-agreed-upon confidentiality or NDA (Non-Disclosure Agreement) timelines, which must be specified in the Project Contract.
4. Custom Furniture & Wood Terms of Sale
1. The Living Character of Wood (Natural Material Disclaimer)
Every piece of furniture crafted by Rabbit Trail Studio is built from solid, live-edge timber. Wood is an organic, living material that naturally responds to its environment.

Environmental Movement: Minor shifting, seasonal expansion, contraction, and hairline surface checking (small splits) are natural characteristics of heirloom wood and do not constitute structural defects.

Color Maturation: Pieces crafted from solid Cherry will naturally mature, oxidate, and deepen in color over time, particularly when exposed to ambient and direct sunlight.

Texture & Hand: Our pieces embrace the hand-hewn character of an artisan shop over machine perfection. Natural character marks, knots, and unique grain configurations are celebrated as part of the individual narrative of the piece.
2. Payment Structure & Custom Deposits

Inaugural / Ready-to-Ship Pieces: Completed works (such as Studio Release No. 1) require 100% payment upfront before the item can be scheduled for delivery or released from the shop.

Custom Trade Commissions: Custom furniture orders require a 50% non-refundable deposit to secure the select timber slabs, materials, and shop scheduling. The remaining 50% balance must be paid in full and cleared prior to delivery, freight loading, or pickup.
3. Production Timelines
Our standard custom production turnaround is four weeks from the date the design specs are approved and the 50% deposit is received. While we respect project timelines, wood curing and hardwax oil finish (Saicos) curing are subject to natural variables. Rabbit Trail Studio reserves the right to adjust timelines slightly to ensure the structural integrity and finish quality of the wood are completely stable before leaving the studio.
4. Logistics, Delivery, and Transfer of Liability

Inspection Upon Receipt: It is the buyer's (or interior designer’s) responsibility to thoroughly inspect the furniture immediately upon delivery or pickup. Any cosmetic or structural concerns must be noted at the time of transfer.

Third-Party Carrier Liability: For pieces shipped via third-party freight or collected by a client’s independent receiver, Rabbit Trail Studio’s liability ends the moment the piece is safely loaded onto the carrier’s truck. We are not responsible for damage incurred during transit, storage, or final installation by third-party handlers.

Storage Fees: Once a piece is completed and the client is notified, it must be delivered or collected within 14 business days. Storage fees may apply to pieces held in the shop past this window unless prior written arrangements are made.
5. Limitation of Liability
To the fullest extent permitted by law, Rabbit Trail Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site; (b) any conduct or content of any third party on the Site; (c) any content obtained from the Site; or (d) unauthorized access, use, or alteration of your transmissions or content.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms.
